This appeal is from a suit brought by Carlos Gonzales against Clarence Jones, consisting of two counts. The first count was in the nature of a trespass to try title involving a tract of land 200 feet by 125 feet less .898 of an acre which was taken by condemnation by the State of Texas. The second count sought title to the full amount of the award paid by the State as condemnor, which had been deposited into the registry of the county court...
