Carl Baughman was killed December 17, 1959, about nine o'clock A.M., on U.S. Highway 11, at the north edge but within the corporate limits of Lumberton, Mississippi. This suit seeks to recover damages for his alleged wrongful death. The defendant, Charles Bremerman, as the employee and agent of the defendant Welborn, was driving a butane gas truck north.
