Appellant was convicted, by jury, in the District Court of Tom Green County, upon an indictment charging him with the offense of intentionally breaking, cutting, and injuring a telephone wire, as denounced by Art. 1334, Vernon's Ann.P.C. Punishment was assessed at confinement in the penitentiary for two years.
