This action was instituted April 24, 1957, by O.T. Little and his wife (plaintiffs) against R.K. Comstock and his wife (defendants) seeking a permanent injunction enjoining the defendants from removing a "partition" fence dividing the lands of the respective parties and from coming on the land of plaintiffs and erecting another fence north of the alleged division fence.
