Tom Stamey brought suit against Cora Davis, a widow, to recover $4,384.74, the amount alleged to be due on a promissory note executed by the defendant and for foreclosure of a mechanic's lien contract. Mrs. Davis made defenses of conditional delivery, payment and partial failure of consideration.
