Lloyd Luman Harris, plaintiff in error, hereinafter referred to as defendant, was charged by information filed in the district court of Creek County with the crime of embezzlement. Trial by jury was waived, and the cause was tried before the court. The court, on December 28, 1959 entered judgment finding the defendant guilty as charged, and fixed the punishment at one year in the State Penitentiary...
