Robert G. Riley (appellee) was employed by James K. Taylor, doing business as James K. Taylor Agency (appellant), who was a real estate broker as a salesman of real estate under a written agreement dated January 17, 1957. We shall hereafter refer to these parties as plaintiff and defendant. The employment continued until terminated by plaintiff on or about December 15, 1957.
