Hubert Edwin Bowman, hereinafter referred to as defendant, was convicted in the County Court of Wythe County of operating a motor vehicle while under the influence of intoxicants in violation of § 18-75, Code of Virginia, 1950. He appealed to the Circuit Court of Wythe County, where the case was tried de novo before the judge without a jury. He was again convicted and his punishment fixed at a fine of $100 and costs.
