This is a criminal action wherein, in the district court for Otoe County, Nebraska, Francis S. Miller, defendant, was tried to a jury on a charge of assault with intent to commit rape upon one Shirley Reeves, who will be referred to as the prosecutrix. The action was prosecuted in the name of the State of Nebraska by the county attorney. The jury returned a verdict of guilty. A motion for new trial was duly filed and overruled.
