This action, tried by the Court without a jury, is brought under the Federal Tort Claims Act, 28 U.S.C. § 1346(b), 2671 et seq., to recover damages in the amount of $250,000 for personal injuries allegedly suffered by the plaintiff as a result of a fall from a scaffold upon which he was working in the General Post Office at 241 Washington Street, Brooklyn, New York, on September 2, 1954.
