BUCHANAN, Justice.

A grand jury of Nelson county on September 22, 1958, returned an indictment against the defendant, Sharon Emanuel Durrette, containing two counts, one charging him with attempting to rape Mrs. Annie Henderson Ferguson, and the other with maliciously wounding her. On his trial to a jury he was found guilty of the charge of attempted rape and sentenced to twenty-seven years in the penitentiary, the punishment ascertained by the jury. We granted him...
