This action, a concursus proceeding, was instituted under the provisions of LSA-R.S. 9:4804 by plaintiff as the owner of the Lazy "S" Ranch in DeSoto Parish, Louisiana, upon which, under a contract of June 21, 1956, with Bounds & Allen, a residence was constructed under the supervision of Lester C.
