CARTER, Justice.

This is a criminal action in which the defendant, John E. Olney, was charged with the crime of motor vehicle homicide, as defined by section 28-403.01, R.R.S. 1943. The defendant entered a plea of not guilty. The jury found the defendant guilty as charged and the defendant was sentenced to serve from 1 to 2 years in the Nebraska State Reformatory for Men, pay a fine of $500, and suffer a suspension of his operator's license for a period of 1 year...
