WHITTLE, Justice.

Satterwhite, a sixteen-year-old youth, was indicted for rape and tried as an adult before the court without a jury. He was found guilty and sentenced to forty years in the penitentiary, the last thirty of which were suspended.

A motion was made to set aside the judgment on the grounds (1) that the evidence was not sufficient to show guilt beyond a reasonable doubt, and (2) that the sentence was excessive. The motion was overruled and we granted...
