Appellant was charged by information with the crime of negligent homicide under RCW 46.56.040. The charging portion of the information reads as follows:

"That the said CHARLES E. BAKER in the County of Pierce, in the State of Washington, on or about the 13th day of September, Nineteen Hundred and Fifty-eight did then and there being unlawfully and feloniously operate a motor vehicle in a reckless manner with disregard for the safety of others...
