Harper would have this court reverse an adverse judgment entered upon a jury verdict. He contends that the case should not have been submitted to the jury as against him because (1) Gribble had not exhausted the intramural remedies afforded him by the constitution of the labor union, and (2) in relation to the matters complained of, Harper was acting within the scope of his employment as an agent of the local union.
