Alice L. Stone, as guardian of Charlotte Frances Stone, an infant, recovered judgment against Reuben Koch in the sum of $10,000 for damages for an alleged assault on the child. A conviction of assault and battery arising from the same conduct was reversed on the ground that the evidence of criminal intent was insufficient to support the verdict. Koch v.
