SHEPARD, J.

This is an action for damages arising out of an accident which plaintiff claims was caused by the alleged negligent operation of an automobile by defendant. After trial by jury, verdict and judgment were rendered for defendant, motion for a new trial was denied, and plaintiff appeals.
