William Birch Hunt was charged with violating Section 304.011, V.A.M.S.1949, by operating his automobile on an undivided Federal Highway about ½ mile west of Columbia, Missouri, at 8:50 p. m. on January 19, 1958, in excess of 65 miles per hour.

On change of venue the case was transferred from Boone to Callaway County. The jury trial resulted in a verdict of guilty and assessment of a fine of $400.
