Defendant was charged with (count 1) murder of Earlean Mosley committed on or about June 4, 1959, and (count 2) murder of Elvira Hay committed on or about August 3, 1958. As to each count he pleaded not guilty and not guilty by reason of insanity, and a jury found him guilty of murder of the first degree, fixed the penalty at death, and found that defendant was sane at the time the offense was committed.
