This appeal resulted from the entry of a decree on March 21, 1959, dismissing Clifton B. Rogers' amended bill of complaint exhibited against Benjamin Harrison Runyon and Lillie T. Runyon, his wife; E. P. Robertson and Mamie R. Robertson, his wife, and H. Selwyn Smith, substituted trustee under a deed of trust in which Rogers was grantor.
