This is a personal injury action arising out of an automobile accident occurring at approximately 7:30 a.m., on December 9, 1957.

Just previous to the accident, the plaintiff had been towing a stalled vehicle north on Bridgeport Way, a north-south thoroughfare in Pierce county just outside the city of Tacoma.
