W. T. Spivey brought suit against Houston Packing Company, seeking to recover for alleged lost profits arising out of plaintiff's failure to earn profit in raising certain broiler chickens fed defendant's feed. Plaintiff's cause of action was based on a letter and oral statements on the part of one John L. Cook, alleged to be the agent of the defendant, said writing and oral statements being to the effect, that if plaintiff attended to the chickens...
