Motion by appellant to vacate order dated January 12, 1959, dismissing appeal, to restore the appeal to the calendar, and for other relief. The District Attorney on behalf of respondent consents to the granting of the motion. Motion granted. The appeal is placed on the calendar for the June 1960 Term, and will be deemed to have been submitted on the record and briefs in the codefendant's appeal (People v. Di Cicco, 10 A.D.2d 734
