Plaintiffs in error, Clarence Wade Anderson, Robert Fred Ashe and Jack A. Kalinka, hereinafter called defendants, were jointly indicted for larceny of diamond rings of the value of $8,214.17, the property of Graves-Steuwer, a jewelry store in Memphis, Tennessee, with an additional count charging Kalinka with being an habitual criminal (T.C.A. § 40-2801 et seq.).

Upon the trial the jury found defendants guilty of the larceny as charged...
