Appellant Robert Floyd Cox and his co-defendants, James Orval Martin, Marvin Avery Olson and Edward Nicolas Miller were jointly charged by indictment with the offense of extortion, and upon a severance being granted, appellant was separately tried and convicted and his punishment assessed at confinement in the penitentiary for 5 years.
