We would reverse the judgment in favor of the plaintiff and dismiss the complaint. Under the charge to the jury plaintiff would have been entitled to recover for a wrongful discharge only if the evidence warranted a finding by the jury that the plaintiff was tried by the railway on charges on which he was not fairly and properly apprised...
