From a judgment on a verdict of guilty of embezzlement defendant appeals. The evidence indicates that defendant Kurt M. Lyman was the president in charge of two separate corporations — the Lyman Finance Corporation and the Lyman Motor Company. On April 15, 1957, as the president of the Lyman Finance Corporation, he issued three checks, drawing its funds from the bank.
