This is an action of tort for trespass and conversion against a deputy sheriff of the county of Barnstable. The declaration is in three counts. In the first count it is alleged that on or about August 20, 1953, the defendant broke and entered the plaintiff's close, namely the land and building thereon known as Shore House Restaurant located in Falmouth; in count 2 it is alleged that on or about August 21, 1953...
