SULLIVAN, Judge.

This is an appeal from a statutory and routine decree of a Superior Court Justice, which affirmed the award of workmen's compensation to the petitioner, against the respondent Town and its insurer.

On July 21, A.D.1956 the petitioner whilst working for the Town sustained an injury to his back, by accident arising out of and in the course of such employment. He suffered discomfort and pain in doing so but completed his day's work. He passed...
