OPINION BY ERVIN, J., November 16, 1960:

On June 23, 1959 a judgment was entered in Magistrate's Court No. 8, Philadelphia County, in favor of the plaintiff in an action in trespass in the amount of $92.83. On July 13, 1959 defendant filed an appeal in the Municipal Court of Philadelphia. On July 17, 1959 the plaintiff filed a motion to strike off the appeal for the reason that the Act of May 17, 1956, P.L. 1626, No. 541, 42 PS § 913a, limits the right of appeal...
