This is a mandamus action instituted August 23, 1958, in the name of the State of Missouri at the relation of the two minor children of their next friend, against the County Superintendent of Schools of St. Louis County. The trial court issued its alternative writ, and respondent made his return and later filed a motion to dismiss the cause and to quash the alternative writ.
