PER CURIAM.

The defendant was indicted for the crime of operating a motor vehicle while intoxicated as defined in Section 321.281 of the 1958 Code of Iowa, I.C.A. The indictment also charged that the defendant had been convicted of operating a motor vehicle while intoxicated, second offense.

He pleaded not guilty, was tried before a court and jury, found guilty and was sentenced to serve a period of not to exceed one year in the state penitentiary as provided...
