Defendant was charged in an indictment with unlawfully, wilfully, and feloniously stealing, taking and carrying away from Solomon's Foods, 1528 Center Street, money in the amount of more than $300, all in violation of Section 709.5 of the 1958 Code of Iowa, I.C.A. After jury conviction of guilty, he was sentenced to be committed to the State Penitentiary at Fort Madison, Iowa, and confined therein, at hard labor, for an indeterminate period as provided...
