By county attorney's information the defendant was charged with the offense of breaking and entering as defined in Section 708.8, Code of Iowa, 1958, I.C.A. Being without funds, the court appointed counsel for him and he entered a plea of not guilty as charged. He later appeared and offered to plead guilty to the lesser and included offense of attempting to break and enter under Section 708.10, Code, 1958, I.C.A. The court approved, and a plea of guilty...
