The appellant, Tom Jones, killed Haskel "Bee" Daniel on Sunday, December 21, 1958. Jones was convicted of voluntary manslaughter and his punishment fixed at eight years and one day's imprisonment.

There had been some trouble between the parties at a polling place on the previous November election, at which time Jones had an open knife in his hand. During the first part of December Jones asked his brother-in-law to sharpen his knife ...
