Patrick Dawson, a resident of Alberta, Canada, appeals from an order denying a motion to quash a subpoena requiring him to testify in this District in the ancillary Chapter X proceedings of Equitable Plan Company. We have previously denied a motion to dismiss the appeal for lack of appellate jurisdiction, 2 Cir., 1959, 272 F.2d 158.
