This is an action brought by Russell York, plaintiff and appellant herein, against M.S. Torbert, defendant and appellee herein, to recover a sum of money for the use of a Caterpillar tractor. Plaintiff alleged in his amended complaint that on July 10, 1958, plaintiff furnished to defendant a Caterpillar tractor, RD8, for use by the defendant on a crushing project for highway construction on the Big Horn Mountains...
