This is an appeal by the defendant, Phillip Duane Jackson, from a judgment of the circuit court which found him guilty of the crime of assault and battery while unarmed. The crime is defined in ORS 163.260. The judgment sentenced the defendant to serve a term of 30 days in the county jail and pay a fine of $250.
