The City of Hialeah, defendant below, appeals from a final judgment of $125,000 entered upon a jury verdict in a wrongful death action.

The appellee's husband was reported missing on May 26, 1957. Approximately three months later, on July 27, 1957, an automobile driven by one Sterling Davis plunged into the Little River Canal at the foot of East 5th Avenue in Hialeah, Florida.
