This is a conviction for aggravated assault upon an officer while in the discharge of his official duties, Sec. 1 of Art. 1147, Vernon's Ann.P.C., with punishment assessed at 90 days in jail.

The testimony shows that about midnight Officer Groves in plain clothes was engaged in the discharge of his official duties and while he was walking along the sidewalk in downtown Dallas appellant drove his automobile to the curb and asked Groves...
