DUFFY, Circuit Judge.

In February, 1953, defendant was charged in two counts, the first, of bank robbery in violation of § 2113(a), Title 18 U.S.C., and the second, an assault with a dangerous weapon in connection with the robbery, in violation of § 2113 (d) of said title. He was convicted upon both counts, and was sentenced to five years on Count I, and to twenty-five years on Count II, the sentences to run consecutively. Defendant is presently incarcerated...
