Trzebiatowski, on January 10, 1957, filed her complaint in the circuit court of Du Page County to nullify and avoid a certain trust agreement between the plaintiff and the defendant and his wife, and such other and further relief as to the court should seem meet, for fraud of the defendant, William C.
