In this opinion we will refer to plaintiff in error, People of the State of Colorado, as the State, and to defendant in error as Denver. Where reference to parties who were defendants in the trial court but not parties to this writ of error is necessary, said parties will be referred to as "users of gas" or as "owners of refunds."
