PER CURIAM.

Nelson is confined in the New Mexico state penitentiary awaiting execution, which has been set for Friday, January 8, 1960.

He was convicted of murder in the first degree on two different occasions, the first conviction having been reversed in State v. Nelson, 1958, 63 N.M. 428, 321 P.2d 202, and the second conviction being State v. Nelson, 1959, 65 N.M. 403
