The appellant was the plaintiff and the appellee was the defendant in the lower court. The plaintiff filed a complaint in chancery seeking damages for an alleged real estate commission due her from the defendant. The defendant filed a motion to dismiss which was granted and the court also transferred the cause to the law side of the court.
