PER CURIAM.

The appeal is submitted upon a clerk's transcript. Defendant was charged by a county attorney's information with the crime of larceny in the nighttime, in violation of Section 709.4 of the 1958 Code of Iowa, I.C.A. and was convicted by jury verdict, and judgment and sentence were rendered thereon. Defendant appeals.

We have examined the record as shown by the transcript and find no error. The judgment is, therefore, affirmed.
