By information defendant was charged with murder and a prior conviction of burglary. He pleaded not guilty, denied the prior conviction, and trial was set for October 16, 1956, before Judge Nye. On October 16 Judge Nye declared a doubt of the present sanity of defendant. (Pen. Code, §§ 1367, 1368.) Counsel for defendant demanded a jury trial on the issue.
