CONDON, Chief Justice.

This is a petition for mandamus which was brought in the superior court against the bureau of fire of the city of Warwick to command it to place the petitioner on the pension list of the city's fire department. The cause is here on his appeal from that court's judgment denying the petition.

After a hearing on the merits the trial justice found that petitioner had resigned from the fire department before the pension fund was established...
