For reasons assigned this (consolidated) day in the case of Derouen v. Lard et al., La.App., 121 So.2d 311, we affirm trial court in his maintenance of an exception ratione materiae, concerning alleged acts occurring prior to November 13, 1959, at plaintiff's costs.
